Art. 27 of Legislative Decree No. 81/2008, as amended by Art. 29, paragraph 19 of Law No. 56 of 29.04.2024, imposes from 1 October 2024 on companies and self-employed workers employed in temporary and mobile construction sites the obligation to obtain a credit (or points) safety licence, issued in digital format by the National Labour Inspectorate, following a specific application.
Subjects carrying out mere supplies or intellectual services, subjects in possession of an equivalent document of another State and subjects in possession of the SOA certificate, in a classification equal to or higher than III, pursuant to Article 100, paragraph 4, of Legislative Decree no. 36/2023, are excluded.
The requirements for obtaining a credit licence are as follows:
- registration with the Chamber of Commerce, Industry, Handicrafts and Agriculture;
- possession of a valid single document of contributory regularity (DURC);
- possession of the risk assessment document (DVR);
- possession of compulsory health and safety training certificates;
- designation of the person in charge of the prevention and protection service (RSPP);
- possession of the certification of fiscal regularity (DURF).
The licence has an initial score of 30 credits and allows individuals to work on temporary or mobile construction sites with 15 credits or more.
The driving licence score is reduced in accordance with the findings of the definitive measures issued against employers, managers and supervisors of undertakings or self-employed workers, in the cases and measures indicated in Annex I-bis to the Decree.
Suspension up to a maximum of 12 months is envisaged in the case of fatal accidents or accidents that cause absolute or partial permanent disability, while revocation is envisaged in cases where one or more declarations made on the presence of the requirements are found to be untrue during subsequent checks.
