I would like to point out to all customers that Decree-Law No. 146 of 21.10.2021, with regard to occasional self-employed workers, has provided for the obligation of prior notification to the territorially competent Labour Inspectorate, by SMS or e-mail.
Awaiting further guidance from the Labour Inspectorate, it is possible to make the communication by means of:
- e-mail PEC to the address: intermittenti@pec.lavoro.gov.it;
- ordinary e-mail to the address: ITL.Roma.occasionali@ispettorato.gov.it;
- SMS to: 339-9942256.
The communication must state:
- data of the principal and the provider;
- place of performance;
- brief description of the activity;
- date of commencement of performance and presumable time frame within which the work or service may be deemed to have been completed (e.g. 1 day, 1 week, 1 month);
- amount of the fee.
It is assumed that, as with intermittents, the use of SMS is only possible for services that begin no later than 12 hours after the communication (and may end even after 12 hours from the communication).
I would like to point out to everyone that, in the event of violation of the new obligation, an administrative sanction ranging from EUR 500.00 to EUR 2,500.00 will be applied in relation to each occasional self-employed worker for whom prior notification has been omitted or delayed.
